In the name of God Amen.
I William Fish of Johnston County in the State of North Carolina make this my last Will and Testament as follows, to Wit.
I lend to my beloved wife, the Manner Plantation where I now live during her life, or widowhood, I also lend her a Negro Wench, Named Phillis, during her life or Widowhood. At her death or marriage the said Negro Wench Phillis is to be sold & the money arising there from to be equally divided among all my Daughters.
I also give my wife four cows & calves also one (gang) of hogs called the Grate Branch Hogs, two feather Beds & Furniture One Bay horse known by the Name Jack, as well as all my household & Kitchen Furniture, Item I give to my son JOHN, all My lands lying on both sides Middle Creek in the County of Wake & State aforesaid, I give to my son JAMES all my lands that I now possess in the County of Johnston & State aforesaid, excepting two hundred acres joining Rich Whittingtons & from Wright lines it being the land I have sold to John Bouldman, also one black mare as well as my saddle & bridle, I give that a Negro fellow named Hercules to be sold & the money arising therefrom to be equally divided between my two daughters to wit: Sally Collins, & Abby, I also desire that all the remainder part of my property consisting of Cattle, hogs, & one Mare, also with the debts due, be made use of to discharge my debts. Item I give to my son JAMES one Negro boy by the name of Ben and in case any thing be left therefrom, after paying my debts the over plush to be equally divided between Soloman Cash, Isom Wright, my son JOHN, RYAS COLLINS. Item I give to RYAS COLLINS one cow and calf.
And lastly I do nominate, constitute, and appoint my wife, SAREY, THOS. LEACH, and EDWARD STEVENS executors of this my last will & Testament hereby revoking & making Void all the wills by me heretofore made. The petition of SALLY COLLINS, widow & relict of Urias Collins, humbly shows that her husband URIAS COLLINS departed this life in the year (smear) intestate leaving your petitioner his widow & the following children & sons at law , surviving him, viz: MINNEY, GIDEON, CANDACE wife of JOHN COATS, LODWICK, TILLY wife of BRYAN SMITH, BETSEY wife of EPHRAIM SMITH, MARIA wife of LEVI FERRILL, PATSY wife of JOHN. BLALOCK and URIAH D COLLINS.
That MINNEY, GIDEON , JOHN. BLALOCK & wife PATSY and URIAH D. COLLINS live in WAKE Co., that BRYAN SMITH & wife TILLY, EPHRAIM and wife BETSEY LEVI FERRILL and wife MARIA & JOHN. COATS & wife CANDACE live in JOHNSTON COUNTY. That LODWICK T. COLLINS is a resident of Alabama.
That at (blank) term of this worshipful court, letters of administration refers to the estate of her said husband were granted to URIAH D. COLLINS.
Your Petitioner. further shows that her said husband was at the time of his death seized & possessed of real estate in Wake County, aforesaid owning that tract or parcel of land on Middle Creek where on her said husband lived for 40 years or more previous to his death. Adjoining the lands of Acril Myatt, Matthew Collins, & others and containing about 450 acres: in which said tract of land your petitioner. shows she is within her rights of dower and to this end that the same be assigned to her. Your petitioner. prays that copies of this petition may (? then served on the several heirs above named according to the Crown of this court & that the sheriff of Wake Co., aforesaid and be directed to summon and impound a jury of good and lawful men, (?) who with the aid of a surveyor shall allot & assign to your petitioner one third part of same tract as her dower, with the dwelling home with its appurtenances as her dower. & that the said sheriff put her in possession of this same according to the acts of the County. and such can(?) provided by your petitioner.
